Premier Partner Referral Program – Terms & Conditions

These Terms & Conditions (“Terms”) govern your participation in the Premier Partner Referral Program (“Program”) offered by [The Kirkpatrick team, Kevin Kirkpatrick who is a Broker Associate with Elevate Real Estate Agency] (“we”, “us”, “our”). By submitting your information through the Premier Partner Site or completing the Premier Partner Intake form, you agree to these Terms.
1. Eligibility
1.1 You must be at least [18] years old and able to complete the form and participate in the Program.
1.2 You agree to provide accurate, complete, and up-to-date information about yourself, your spouse/partner, and your children (if applicable), and you confirm that you have the authority and consent to share that information with us.
2. Program description
2.1 The Program is designed to provide enhanced communication, relationship-building, and real estate-related services, including but not limited to personalized outreach, events, offers, and information based on the details you share.
2.2 Participation in the Program does not obligate you to buy or sell property through us, and it does not guarantee any specific outcomes (including, without limitation, financial results, home purchases, or sales).

3.1 By applying to join the Program and submitting your information, you consent to receive communications from us via email, phone, text message (if applicable), and other channels you make available, regarding:

Personalized messages, offers, and invitations based on your interests and preferences
3.2 You may opt out of marketing communications at any time by using the unsubscribe link in our emails or by contacting us at info@kirkpatrickteam.com. Even if you opt out, we may still send you non‑marketing messages related to the Program or our ongoing relationship were permitted by law.

9. Termination and suspension

9.2 We may suspend or terminate your participation in the Program at any time, with or without notice, if:
We believe you have violated these Terms
We discontinue or materially change the Program
The service provided is not a mutual fit for the purposes of the program

10. Disclaimer of warranties
10.1 The Program is provided “as is” and “as available” without any warranties of any kind, whether express or implied, including warranties of business growth, purpose, or non‑infringement, to the fullest extent permitted by law.
11. Limitation of liability

12. Indemnification
12.1 You agree to indemnify and hold harmless Kevin Kirkpatrick, Kirkpatrick Team, Elevate Real Estate Agency, its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) that arise out of or are related to:
Your participation in the Program
Your violation of these Terms
Your violation of any rights of another person in sharing their information with us
13. Governing law and disputes
13.1 These Terms are governed by the laws of California, without regard to its conflict of law principles.
13.2 Any disputes arising out of or relating to these Terms or the Program will be resolved in the courts of County/City, State/Province, and you consent to the exclusive jurisdiction of those courts.
14. Changes to the Program or these Terms
14.1 We may update or modify the Program and/or these Terms from time to time. When we make changes, we will update the “Last updated” date above and may provide additional notice as appropriate.
14.2 Your continued participation in the Program after changes become effective means you accept the updated Terms.
